呼籲國際社會持續關注“709大抓捕”，敦促中國政府尊重正當程序、恪守法治承諾，立即釋放38名被違法扣押的維權律師及公民共同聲明
（2016年1月9日 香港）中國政府去年7月9日凌晨起大規模抓捕維權律師及公民，迄今已整整6個月。目前仍有14位律師及22 位公民受到不同形式的羈押，包括秘密囚禁，甚至處於完全失蹤狀態；另有33位律師和公民被禁止出境。
中國維權律師關注組（關注組）、台灣聲援中國人權律師網絡特於今天聯同全球106個民間團體再次發出聲明，呼籲國際社會繼續關注所有仍被關押人士的身心健康及安全。
對於當局嚴重侵犯律師及公民合法權利的違法行徑，我們表示極度遺憾和嚴正譴責。
我們注意到，由去年7月至今，709案件被捕人士的辯護律師及家屬一直多方奔走，力求在法律框架內尋求救濟，但卻不得要領。大部份被拘禁的人權律師及公民至今仍未獲准會見辯護律師。
鑑於中國刑事訴訟法中規定的37日拘留及批捕期限早已過去，最長六個月的監視居住亦即將屆滿，我們謹在“709大抓捕”滿6個月之際再次呼籲國際社會給予密切關注和大力支持，並敦促中國政府：
•尊重中國作為聯合國的會員國及多項國際公約締約國的身份，踐履對國民作出的依法執政、依法治國承諾，遵守本國刑事訴訟法明定的一切正當程序，立即停止違法羈押，公開所有被秘密拘押人士的所在地，並確保其身心健康及安全。
•對於38名被違法扣押的維權律師與公民，若未於監視居住六個月屆滿時依法批捕，必須遵照本國刑事訴訟法之規定，立即恢復其人身自由。
•確保律師能正常履行職責，不受恫嚇、妨礙或不當干涉；律師按照公認的專業職責、準則和道德規範所採取的任何行動，不應受到或被威脅受到起訴或行政、經濟或其他制裁。
•對有濫權濫捕行為的執法人員及執法機關，依法予以調查追究及制裁。
背景
“709大抓捕”是維權律師自2003年出現以來遭遇的規模最大、涉及人數最多、持續時間最長、程度最嚴厲的打壓。整整6個月內，全國至少24省316名律師、律師助理、律所人員、維權人士及家屬遭受影響，包括被傳喚、強制談話、限制出境、軟禁、指定監視居住、刑事拘留、逮捕或失蹤。
與2011年“茉莉花革命”期間相比， 709事件的打壓手段更加多元而隱蔽。除借“指定居所監視居住”之名對維權律師及公民實施長達半年的秘密羈押外，亦利用“媒體審判”抹黑維權律師形象，以“株連親友”加大懲罰範圍並散播恐懼，以“警示教育”阻嚇其他律師效仿，借“屏蔽通訊”阻斷各方連接和聲援。
中國人權法治狀況近年有惡化跡象，公民社會活動空間持續收窄。2015年可謂是中國公民社會的寒冬之年。多家民間機構相繼關閉，“維權律師”、“地下宗教”、“異見人士”、“網路領袖”、“弱勢社群”遭大規模抓捕。
中國作為國際社會一員，無視人權法治的國際準則，公然違反踐踏本國法律，是對習近平主席提出的依法治國承諾的持續嘲弄。
我們重申，律師是推進一國之法治、國民之人權不可或缺、彌足珍貴的理性力量。若律師都沒有人權，法治和人權必將蕩然無存。
